§ 1 Scope and Provider
1.1 The following Terms and Conditions (T&Cs) apply to all orders of goods and services placed by a consumer via the online shop www.lifefullofpassion.de, operated by managing director Jaqueline Schaupp. Customers may contact us by email at info@lifefullofpassion.de.
1.2 A consumer, within the meaning of the law (§ 13 BGB) and these T&Cs, is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession.
1.3 The product offerings in our online shop are directed exclusively at buyers who are at least 18 years old.
1.4 The contract language is exclusively German.
1.5 You may view and print the currently valid Terms and Conditions on our website.
§ 2 Conclusion of Contract
2.1 The presentation of goods in the online shop does not constitute a legally binding offer, but rather an invitation to order.
2.2 By clicking the “Order now” button, you place a binding offer to purchase the goods in your shopping cart (§ 145 BGB).
2.3 Upon receipt of your purchase offer, you will receive an automatically generated email confirming receipt of your order (confirmation of receipt). This confirmation does not constitute acceptance of your purchase offer. A contract is not yet formed by this confirmation.
2.4 A purchase contract is only concluded once we expressly declare acceptance of the offer or when the goods are dispatched to you without a prior explicit declaration of acceptance.
§ 3 Prices
The prices listed on the product pages include statutory VAT and other price components but do not include shipping costs.
§ 4 Delivery and Self-supply Reservation
4.1 If not all ordered products are in stock, we may make partial deliveries at our expense, provided this is reasonable for you.
4.2 We expressly reserve the right to withdraw from the contract if we are not supplied by our supplier through no fault of our own. In such a case, we will inform you immediately and refund any payments made.
§ 5 Retention of Title
The goods remain our property until full payment has been made. Prior to transfer of ownership, the goods may not be pledged, transferred by way of security, processed, or transformed without our consent.
§ 6 Shipping
6.1 All prices shown include VAT and other price components but exclude applicable shipping costs.
6.2 When our website is updated, all previous prices and information become invalid. The valid version is the one at the time of ordering.
6.3 All shipments within Germany are free of charge. Shipping costs for other countries are clearly stated in the FAQs or on the checkout page.
§ 7 Payment Terms; Default
The following payment options are available: Credit card (MasterCard and Visa), PayPal.
7.1 For advance payment, we will provide our bank details with the order confirmation. Once the amount has been received, we will dispatch the goods.
7.2 For purchases on account, the amount is due 14 days after receipt of delivery.
7.3 For Sofortüberweisung.de, you can pay easily and securely without registration using your online banking credentials. More information: https://www.payment-network.com
7.4 For credit card payments, your card will be charged upon order confirmation. You will be asked to provide your card number, name, expiry date, and the security code.
7.5 For PayPal payments, enter your email and password at the end of checkout. Payment is credited immediately, and the goods are shipped upon confirmation by PayPal.

7.6 In the event of chargebacks due to insufficient funds or incorrect bank details, you may be liable for any resulting costs unless you prove that the fee was lower.
§ 8 Right of Withdrawal
If you are a consumer as defined by § 13 BGB, you have the right to withdraw from this contract within fourteen days without providing any reason.

by means of a clear statement (e.g., a letter sent by post or email). Use of the sample withdrawal form is optional. Sending the notice before the deadline is sufficient.
Consequences of Withdrawal
If you withdraw, we will refund all received payments including delivery costs (except additional costs due to your choice of non-standard delivery) within fourteen days. We will use the same payment method used in the original transaction unless otherwise agreed. We may withhold reimbursement until we have received the goods or proof of return. You must return the goods within fourteen days of notifying us. You bear the direct return shipping costs.
You are only liable for diminished value if it results from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
§ 9 Special Notice
9.1 The right of withdrawal does not apply to custom-made products or sealed items unsuitable for return for health or hygiene reasons once unsealed. Gift vouchers cannot be split, exchanged for cash, or refunded.
9.2 Some products include a pink security seal with a number. Please avoid removing or damaging the seal during fitting. Only products with an intact seal qualify for the 14-day return policy.
9.3 Please avoid damage and contamination. Return goods with all original packaging and accessories. If the original packaging is no longer available, use suitable packaging to prevent transport damage.
§ 10 Warranty
Statutory warranty provisions apply.
§ 11 Data Protection
Data processing is carried out in accordance with the German Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). See our privacy policy for more details.
§ 12 Liability
12.1 Unlimited liability: We are liable for intent and gross negligence. For slight negligence, we are liable in accordance with the Product Liability Act and for injury to life, body, or health.
12.2 Limited liability: For other cases of slight negligence, we are only liable for breach of essential contractual obligations (cardinal duties). This limitation also applies to our agents.
§ 13 Final Provisions
13.1 German law applies to all contracts, unless mandatory consumer protection laws of your home country apply.
13.2 The UN Convention on Contracts for the International Sale of Goods does not apply.
13.3 If any provision is invalid, the rest of the contract remains valid. Invalid provisions will be replaced by applicable legal regulations.
